There Are Certain Legal And Accounting Issues When A Non-Resident Of Canada Acquires Property In Canada. 

A large percentage of Whistler homebuyers and investors live around the world. A real estate purchase by a non-resident can be simple and stress-free by using the services of a Canadian accountant or lawyer specializing in British Columbia real estate. We recommend speaking to these professionals before making any purchase decisions. 

Canadian income tax legislation requires non-residents to pay 25 per cent of gross rental income to Canadian taxation authorities as security for actual taxes due. Purchasers can frequently obtain an exemption from this requirement by formally filing a budget: property rental managers usually assist with this. It's important to file annual income tax returns in order to retain the exemption. 

Non-resident corporations need to provide extra documentation to satisfy land registration requirements. For instance, if the corporation is going to carry on commercial activity (rent property on a nightly basis), then the corporation will have to be extra-provincially registered in British Columbia. 

If it is a one-time purchase and the corporation does not do business in British Columbia, the corporation will only have to file a certificate of incorporation, certificate of good standing and affidavit of no commercial activity. Extra-provincial registration is more involved. Both procedures take time and completion dates should reflect this. Original documentation is required from the home jurisdiction's authority over corporations. 

When financing your purchase using a Canadian financial institution, most will require a down payment of between 35 and 50 per cent. There are ways to fund this down payment to avoid depleting your cash reserves. Denise will be happy to discuss this with you personally.

If you wish to buy a home but consider yourself incapable of getting credit, you may be living in the past in terms of assessing your financial situation. Lenders have become more flexible in underwriting mortgage loans.

A recent survey of mortgage lenders revealed some interesting trends. Ninety-six percent of those surveyed had cut their standard down payment requirements for moderate-income buyers, and 93% said they are more lenient regarding debt-to-income-ratios. Ninety-four percent of those surveyed said they now have more flexible approaches to credit histories, and look at rent and utility payments more than credit cards. Seventy-nine percent of lenders say they have relaxed employment criteria. They now look more at your capacity to generate a stable flow of income rather than requiring a long history at one job.

There are more lenders today, and they are in fierce competition with each other. The home loan industry has created entire markets that cater to those with less-than-perfect credit.
